Terms, Conditions, and Rental Guidelines for the AICON 82 OPEN SOARIS (Effective from 01/08/2024)

The AICON 82 vessel, which is the subject of these terms, conditions, and rental guidelines, is exactly as described on the pages of the website www.sicilyachts.com, where every characteristic, including technical specifications, identifying data, cabins, and other details, is specifically highlighted, outlined, and illustrated both through written content and visually through photographic and video content.

The renter is obliged, upon boarding the vessel, to inspect it to verify the accuracy of what is published and described on the web pages at www.sicilyachts.com. Consequently, by signing the contract on board the vessel, the renter expressly declares that they find it, even in relation to their own expectations, undeniably suitable and, above all, in perfect working condition for the intended use during the rental period. This is also in consideration of having reviewed, on board, the vessel’s condition and maintenance documentation, thereby confirming its suitability for navigation and the purpose for which it is rented.

Once the renter makes the rental payment, they are required to sign the contract according to the terms, conditions, and procedures outlined herein, also assuming responsibility for the custody of the vessel. By making the payment, the renter acknowledges it as fair and non-refundable for any type, kind, or nature of claim and/or dispute.

The renter expressly declares and accepts, by signing this contract after the payment has been made, that they will never request and/or claim from the owner any type or kind of refund or compensation for damages, of any type, kind, or nature, arising from this contract. This is because, as stated above, the vessel, upon signing this contract, is delivered to the renter in an efficient and perfectly operational condition for the intended use during the rental period, and therefore, no valid or founded objection, of any type, kind, or nature, may be raised against the owner, including any request for refund and/or compensation for damages.

By signing this contract, the renter assumes all direct and indirect risks related to the vessel, including its operation and/or any downtime, thereby absolving the owner of any type or kind of liability, including the return of any payments made, even if the payment was made directly through web platforms where the vessel is advertised for rental. The renter authorizes the platform to process the payment with no possibility of raising exceptions or disputes of any kind.

In the event the renter causes damage to the vessel, they acknowledge and agree to cover the entire documented cost with an immediate advance payment of €20,000.00 as a deposit. The terms, conditions, and guidelines of this contract apply even if the rental includes a crew and captain on board the vessel.

The terms, conditions, and guidelines of this agreement prevail over any other agreements, even if the agreement was finalized through web platforms where the vessel is advertised for rental.

The renter absolves the owner from any liability related to the vessel’s use for the rental period, with no possibility of extension unless expressly agreed upon and signed by both parties.
